The Department of Telecommunications and Cable (DTC) regulates the telecommunications and cable industries in accordance with statutory obligations imposed by the Commonwealth of Massachusetts and the federal government. The Department seeks to ensure consumers receive high quality communications at just and reasonable rates, and promotes sustainable competition to increase consumer welfare for all Massachusetts residents.
The Counsel II will assist the General Counsel in carrying out the mandate of the Department, through serving as a hearing officer on agency adjudications, performing legal and policy research on issues affecting consumers in the Commonwealth, and providing legal advice on telecommunications and cable cases and issues as necessary to support the work of the agency. The position includes legal and policy-related work in Department investigations and non-routine projects, including Department activities related to FCC, federal legislative matters and other State matters.
The Counsel II contributes to the development of Department policy and precedent by effectively participating in Department projects and cases, and by performing legal and policy analysis and making recommendations. Specific duties may include:
Represent the Department as a hearing officer at administrative hearings. Duties include preparing fully for a hearing by evaluating complaints to determine if they warrant action; compiling the evidentiary record; ruling on motions and objections; conducting cross-examination at hearings in a thorough, organized, and professional manner; and determining the legal strategy to be used in settlement of cases. The Counsel II is responsible for ensuring that the hearings run smoothly and that the parties are accorded due process. Must maintain up-to-date hearing files and complete paperwork associated with closing out cases.
Review and draft Orders that utilize evidence that supports the law by thoroughly and accurately examining relevant precedent, the factual record, and any analysis provided by industry experts and others. Submit information requests on time, which are clearly written, comprehensive, and consistent with standard format.
Draft public filings (e.g., FCC Comments), regulations, and legal memoranda on a range of legal and policy topics, including but not limited to, telecommunications and cable.
Draft and review legislation, regulations, and industry publications concerning issues that affect the Department. Contribute to the development of Department policy and precedent by effectively participating in Department projects and cases, and by performing legal and policy analysis and making recommendations.
Keep up to date on the current state of the law, especially regarding telecommunications and cable. Develop and maintain a detailed familiarity with industry issues, through research, discussion with other Department staff, senior staff, and the Commissioner, and other industry sources. Review court decisions and newly enacted state and federal regulations. Conduct legal and policy research and provide advice on telecommunications and cable matters.
Work cooperatively with members of the legal, competition, consumer and administrative divisions to prepare informative, well-written, and well-reasoned memoranda for the Commissioner and senior staff examining proposed and newly-enacted laws, regulations, and policies to explain how current Massachusetts policies may be affected.
Work collaboratively with the Department’s staff and other MA agencies including EOHED, OCABR, MTC, MBI, EOPPS, State 911 Department, Department of Public Utilities and The Office of the Attorney General.
Be able to work independently by thoroughly reviewing and analyzing filings and other data submitted by parties or obtained independently. Conduct assigned routine, ongoing project work in a thorough, comprehensive, accurate, and timely manner. Keep managers informed of issues requiring their attention, but work independently and conduct activities with minimal supervision. Interact with industry and other representatives in a professional manner.
Monitor activities at the FCC, NARUC, Congress, etc. and assist in drafting and reviewing comments representing Department positions. Recommend participation in FCC proceedings and action (opposition or support) for proposed federal telecommunications and cable legislation deemed to have a significant impact on Massachusetts's telecommunications and cable markets and consumers.

SALARY PLACEMENT IS DETERMINED BY YEARS OF EXPERIENCE AND EDUCATION DIRECTLY RELATED TO THE POSITION AND THE HUMAN RESOURCES DIVISION’S RECRUITING GUIDELINES. IN THE CASE OF A PROMOTIONAL OPPORTUNITY, THE SALARY PROVISIONS OF THE APPLICABLE COLLECTIVE BARGAINING AGREEMENT WILL APPLY TO (OR WILL BE UTITLIZED FOR) PLACEMENT WITHIN THE SALARY RANGE .
Proven legal research and writing ability.
Ability to effectively communicate complex matters verbally and in writing.
Experience in administrative law and rulemaking.
Experience with telecommunications, cable, and broadband law & regulations.
Strong time management skills and ability to balance multiple projects and cases.
Strong analytical skills.
Knowledge of industry technology.

MINIMUM ENTRANCE REQUIREMENTS: Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and (A) at least three years of full-time, or equivalent part-time, professional experience in the practice of law.
Incumbents may be required to have a current and valid Motor Vehicle Drivers License at a Class level specific to assignment.
